Terms and Conditions

By confirming your booking and payment, you agree to Pickle Point's Terms and Conditions, including the Participation Waiver and Release of Liability set out below. In these terms, "Pickle Point" or "the Facility" means the outdoor pickleball facility operated by Pickle Point (ABN 19 679 380 995), including its directors, officers, employees, contractors and related entities.

1. Bookings and Payment

• All court bookings must be made and paid for through our online booking system unless otherwise arranged.

• Bookings are confirmed only once payment has been received in full.

• Hirers must finish play by the end of their designated booking time. If the court remains available, the session may be extended and an additional charge will apply.

2. Cancellations, Rescheduling and No-Shows

 

Casual Bookings

• Cancellations made 24 hours or more before the booking time: your booking will be rescheduled to another available date and time of your choice, at no charge. Simply contact us to arrange your new booking.

• Cancellations made within 24 hours of the booking time: the booking fee is forfeited.

• Rescheduled bookings are subject to court availability.

No-Show Policy

Failure to attend a booked session without cancelling is treated as a late cancellation, and the booking fee will be forfeited.

Special Events, Tournaments and Coaching Programs

Some events or specialty programs may have separate cancellation policies, which will be communicated at the time of booking.

3. Outdoor Weather Policy

Pickle Point is an outdoor facility and play is subject to weather conditions. Our GreenSet Cushion courts are generally quick to dry after rain.

• If rain prevents or interrupts your session, you may choose either a full refund or to reschedule your booking to another available date and time — whichever you prefer.

• Bookings are not automatically cancelled in wet weather. To cancel a booking due to rain, you must contact Pickle Point before or at your booking time. Wet-weather refunds and rescheduling will not be processed unless you reach out to us.

• If you do not contact us and do not attend, the booking will be treated as a no-show under clause 2.

• If heavy rain, lightning or other conditions make play unsafe, the Court Manager may close the courts. If we close the courts, the same choice of refund or rescheduling applies.

 

4. Outdoor Conditions Acknowledgement

As an outdoor venue, you acknowledge and accept that:

• courts, surrounds and pathways may be affected by weather, moisture, leaves, debris, insects or wildlife;

• sun exposure, heat, cold, wind and glare are inherent features of outdoor play, and you are responsible for your own sun protection, hydration and appropriate clothing and footwear;

• court lighting is provided for evening play, and visibility may vary with light and weather conditions.

 

5. Safety and First Aid

While Pickle Point has extensive operating hours, we cannot always guarantee that a certified first aid officer will be onsite. Court hirers are responsible for their own safety, including having first aid supplies on hand. Play is at your own risk.

Participation Waiver and Release of Liability

TERMS AND CONDITIONS OF ENTRY AND PARTICIPATION

In consideration of being permitted to enter, use or participate in any activities at the Facility, I acknowledge and agree as follows:

6. Participation at Own Risk

I acknowledge that I enter and use the Facility, and participate in any activities conducted at or in connection with the Facility (Activities), entirely at my own risk.

 

7. Acknowledgement of Risk

I understand that the Activities, including pickleball, training, competitions and general use of the outdoor courts and facilities, involve inherent risks. These risks include physical injury from slips, trips and falls (including on wet, uneven or debris-affected surfaces), collisions with other participants or fixed structures (including fencing, nets and posts), impact from balls, paddles or equipment, physical exertion, heat-related illness, sun exposure, and other risks arising from outdoor conditions that may result in injury, illness or death. I voluntarily assume all risks associated with my participation, whether known or unknown.

 

8. Release and Waiver

To the fullest extent permitted by law, I waive and release the Facility from all claims, liabilities, losses or damages arising out of or in connection with my entry to the Facility or participation in the Activities, including those arising from negligence.

9. Australian Consumer Law

Nothing in this waiver excludes, restricts or modifies any rights I may have under the Competition and Consumer Act 2010 (Cth). Where liability cannot be excluded, it is limited to the resupply of the services or the cost of resupply. To the extent permitted by law, liability for death or personal injury arising from the supply of recreational services is excluded.

10. Health and Medical

I confirm that I am physically fit to participate and will not do so if injured, unwell or medically unfit, including in hot weather where I am at risk of heat-related illness. If I require medical assistance, I authorise the Facility to arrange first aid or emergency treatment as reasonably necessary, and I accept responsibility for any associated costs.

 

11. Conditions of Entry and Conduct

Pickle Point is a family-friendly venue. I agree to:

• comply with all venue rules, policies and staff directions;

• show respect to other players, visitors and staff;

• use equipment, courts and facilities appropriately;

• behave safely and responsibly at all times;

• not play loud music on speakers — personal speakers must be kept at a low volume that does not disturb other players or neighbouring properties;

• dispose of rubbish in the bins provided;

• close all gates after use; and

• turn off any court lights when leaving after an evening session.

 

The Facility may refuse entry to, or remove, any person for unsafe or inappropriate conduct, with no refund given.

 

12. Personal Property

I am responsible for my personal belongings. The Facility is not liable for loss, theft or damage to personal property, including property left at the courts or affected by weather.

13. Damage and Responsibility

I am responsible for any damage caused by my negligent, reckless or improper use of the Facility or its equipment, including damage to court surfaces, nets, fencing and lighting.

 

14. Photography and Recording

I acknowledge that CCTV operates at the Facility and that photographs or video may be taken for operational or promotional purposes.

 

15. Indemnity

I agree to indemnify and hold harmless the Facility, its directors, officers, employees and contractors from and against any claims, liabilities, damages, losses or expenses (including legal costs) arising out of or in connection with:

• my breach of this agreement;

• any negligent, reckless or unlawful act or omission by me; or

• any damage caused by me to persons, property or the Facility.

 

16. Privacy

I acknowledge that the Facility may collect, use and store my personal information for the purposes of bookings, memberships, safety, communication and facility operations. Personal information will be handled in accordance with applicable privacy laws and the Facility's privacy policy.

17. General

This waiver applies to all current and future entry to and participation at the Facility. If any part of this agreement is invalid, the remainder continues in effect. This agreement is governed by the laws of New South Wales.

 

18. Acknowledgement

I confirm that I have read and understood these Terms and Conditions, including the Participation Waiver and Release of Liability, and agree to be bound by them.
